As per Article 93(2) of the Constitution of the People’s Republic of Bangladesh, the Anti-Corruption Commission (Amendment) Ordinance, 2025 ceased to have legal effect on 11 April 2026, as it was not approved by Parliament within 30 days of the first sitting of the 13th National Parliament on 12 March 2026.
The Anti-Corruption Commission (Amendment) Ordinance, 2025 had introduced a statutory obligation to establish Special Judge Courts in all locations where ACC offices exist or are established.
Observation

On 23 June 2026, it was reported that the ACC was preparing a preliminary draft law retaining the provision of the Anti-Corruption Commission (Amendment) Ordinance, 2025 that required the establishment of a Special Judge Court whenever an ACC office is established in a district. The provision links the expansion of Special Judge Courts directly to the establishment of ACC district offices. The ACC Secretary stated that the draft remained under discussion and could be revised.
Three opposition members of the special parliamentary committee, Md. Mujibur Rahman, Md. Rafiqul Islam Khan and G. M. Nazrul Islam, submitted notes of dissent regarding the recommendation on the ACC Ordinance. In their dissent, they emphasised the importance of the Ordinance and called for it to be passed as a bill without amendment. Full implementation of this proposal will depend on the elected government’s legislative action and political support for retaining this provision in the proposed law.
As provided in the following amendment to the Anti-Corruption Commission Act, 2004, introduced through the Anti-Corruption Commission (Amendment) Ordinance, 2025:
Act 5, Section 4(2) of the Anti-Corruption Commission (Amendment) Ordinance, 2025 provided that, in all places in the country where offices of the Commission exist or are subsequently established, the appropriate authority shall, immediately following the establishment of such offices, establish one or more Special Judge Courts. This provision had given legal effect to the reform proposal by mandating the parallel establishment of Special Judge Courts alongside existing and future ACC offices.
